Petitioner is in jail custody since 16.01.2016 and earlier his prayer for bail was rejected by this Court vide order dated 19.05.2016 passed in Cr. Misc. No. 20906 of 2016 taking note of the facts and circumstances of the case but submission on behalf of the petitioner is that petitioner was caught on mere suspicion and the cash recovered from possession of the petitioner belonged to the petitioner and, moreover, no arms was recovered from possession of the petitioner.

Para-3 of the petition goes to show that prior to institution of the present case, petitioner had been made accused in Dehri P.S.case No. 305 of 2010 and except the above stated case

Patna High Court Cr.Misc. No.40429 of 2016 (2) dt.28-09-2016 2/2 as well as present case, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri ( T) P.S.Case No. 32 of 2016.
