The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 307, 504, 506 of the Indian Penal Code.
The prosecution case, in brief, is that while the informant was going to purchase some articles from a shop, the accused persons assaulted her due to which, she sustained injury. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The injury is on non-vital party of the body. At best, a case u/S 325 of the Indian Penal Code is made out. Both parties are agnates.
Patna High Court Cr.Misc. No.68491 of 2018(2) dt.29-11-2018 2/2 The dispute had taken place due to partition of property. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chand P.S. Case No. 147 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V.//- U T
