JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sherghati (Dobhi) P.S. Case No. 497 of 2018 instituted for the offence under Section 414/34 of the Indian Penal Code and Section 30(d) of Bihar Prohibition and Excise Act, 2016.

As per seizure list Mahua flower has been recovered near the house of co-accused Bipul Kumar Choudhary. He has been apprehended by the police. The name of petitioner has been disclosed by co-accused Bipul Kumar Choudhary. Counsel for the petitioner submits that co-accused Bipul Kumar Choudhary has already been granted bail by coordinate Bench of this Court vide order dated 29.10.2018 passed in Cr. Misc. 63654 of 2018.

Patna High Court Cr.Misc. No.66257 of 2018 (2) dt.06-11-2018 2/2 Petitioner is said to be in custody since 24.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Sherghati (Dobhi) P.S. Case No. 497 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
