JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Petitioner is permitted to make necessary correction in Para 10 of the petition within course of the day. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, it was co-accused Pramendra Singh, who shot fire on the deceased and so far as petitioner is concerned, it is only stated that he having armed with lathi was present on the place of occurrence. Moreover, some coaccused having similar allegation have already been granted privilege of bail by co-ordinate Benches of this Court. The learned court below has mentioned in the impugned order that the anticipatory bail of the petitioner was rejected in the year 2014 but
Patna High Court Cr.Misc. No.40841 of 2016 (2) dt.03-10-2016 2/2 in spite of that, he did not surrender and police submitted charge sheet showing him absconder.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Session Judge, Siwan in connection with Session trial no. 439 of 2014 arising out of Siswan( M.H.Nagar) P.S.Case No. 60 of 2012.
