Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 467, 468 and some other ancillary Sections of the Indian Penal Code and u/s 66(B)(C)(D) of the IT Act.

As per the prosecution case, this petitioner on the assurance of providing loan and installing mobile tower cheated many villagers and on search of house of this petitioner one laptop, ATM cards of different banks, three cheques and congratulation message for installing mobile tower have been recovered.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the

Patna High Court CR. MISC. No.63114 of 2021(5) dt.24-11-2022 2/2 conscious possession of the petitioner and he is no way concerned with the alleged recovery. No one has made any complaint against this petitioner. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that petitioner cheated the informant on the assurance of providing loan and installing mobile tower and on search of house of this petitioner one laptop, ATM cards of different banks, three cheques and congratulation message for installing mobile tower have been recovered.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
