JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Excise Case No. 374 of 2018, registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 540 liters Nepali liquor from the vehicle of the petitioner and the petitioner is named in the F.I.R.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from the conscious possession of the petitioner and he has having no criminal antecedents and he is in judicial custody since 17.09.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court Cr.Misc. No.67162 of 2018(2) dt.27-11-2018 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Excise Case No. 374 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
