The petitioner in the present case is seeking regular bail in connection with Narpatganj P.S. Case No. 126 of 2019 registered under Sections 302/34 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Araria.

Learned counsel for the petitioner submits that there is general and omnibus allegation of assault against the petitioner and he has been falsely implicated in this case. Learned A.P.P. for the State has opposed the prayer for regular bail of the petitioner. Learned counsel submits that there is specific allegation of committing assault by means of Kulhari (axe) on her head and due to that she succumbed to death.

Patna High Court CR. MISC. No.51906 of 2019(3) dt.20-11-2019 2/2 Considering that there is specific allegation of committing overt act which proved fatal and killing of the informant's wife, this court is not inclined to grant regular bail to the petitioner.

Prayer for regular bail of the petitioner is refused. The trial court is directed to expedite the trial of the case.
