Petitioner, in the present case, is seeking regular bail in connection with Marhowrah P.S. Case No. 439 of 2020 registered for the offences punishable under Section 30/30(A) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that earlier prayer for regular bail of the petitioner was rejected by this court vide order dated 15.04.2021 passed in Cr. Misc. No. 5545/2021.
Having regard to the observations of this court recorded in the order dated 15.04.2021 passed in Cr. Misc. No. 5545 of 2021, wherein this court had granted liberty to the petitioner to renew his prayer for bail after six months, taking note of the submission that petitioner has remained in custody
Patna High Court CR. MISC. No.63082 of 2021(2) dt.24-11-2021 2/2 for more than seven (7) months after the previous rejection, this court directs release of the petitioner above named on bail on furnishing of bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge - cum - Special Judge, Excise, Saran in connection with Morhowrah P.S. Case No. 439 of 2020, subject to the condition as laid down under Section 437 (3) Cr.P.C.
And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
