JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 394 and 384 of the Indian Penal and 47 A, 53 C, 54 of the Bihar Excise Amendment Act, 1915.

Allegation in brief is that petitioners along with others tried to loot the pick-up van driver. In the meantime, the police came and apprehended the petitioners.

Learned counsel appearing for the petitioners submits that the allegation is false and fabricated. In the evening, occurrence is alleged to have committed but no any incriminating article or looted article was recovered from the possession of the

Considering the aforesaid facts and circumstances, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria (RS) P.S. Case No.651 of 2016. (Arun Kumar, J) N.H./- U T
