Petitioner seeks bail in connection with Kotwali (Adampur) P.S. Case No. 464 of 2016 registered under Sections- 379/411 of the Indian Penal Code.

The allegation against the petitioner is of taking away one empty cylinder from the vehicle of the vendor while he was attending the call of nature.

Learned counsel for the petitioner submits that recovery has not been made from the possession of the petitioner. It is further submitted that from first information report it appears that petitioner was caught by the police with

Patna High Court Cr.Misc. No.52952 of 2016 (2) dt.14-12-2016 cylinder and seizure list was prepared in that connection, however seizure list does not bear the signature of the petitioner. Petitioner is in custody since 07.09.2016. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Maigstrate, Bhagalpur in connection with Kotwali (Adampur) P.S. Case No. 464 of 2016.
