JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that the victim has specifically stated in her statement recorded under Section 164 of the Code of Criminal Procedure that she was kidnapped by petitioner and others and, after that, she was kept in the house of the sister of co-accused Lallan Sada, where petitioner and others committed rape on her, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with POCSO Case No. 2 of 2016, arising out of Bakhtiyarpur ( Balwahat O.P) P.S.Case No. 494 of 2015, pending in the court of Additional Session Judge-I, Saharsa, stands rejected.
