2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act, registered in connection with Bhagwanpur P.S. Case No. 96 of 2024.

3. As per the allegation, five accused persons were apprehended while making planning to commit some serious offences. From possession of the petitioner, one loaded country made pistol with one cartridge and two mobile phones were recovered.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.55111 of 2024(2) dt.20-08-2024 2/2 that the petitioner is innocent and he is under custody since 18.04.2024. As a matter of fact, nothing was recovered from his possession.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. It appears that the petitioner has a criminal antecedent of a case registered under Section 395 of the I.P.C.

7. Considering the above-mentioned facts and circumstances of the case, the prayer for bail of the petitioner is rejected.

8. However, the petitioner, if so advised, may renew his prayer for bail after framing of charge or after six months whichever is earlier.
