JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Excise Case No. 335 of 2018, registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 7 liters liquor from the hut of the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the hut does not belongs to the petitioner. Further submission is that though the petitioner is accused in one more case, but he is on bail in that case and he is in judicial custody since 12.09.2018. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.67164 of 2018(2) dt.27-11-2018 2/2 bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari, in connection with Excise Case No. 335 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
