====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-08-2023 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 326, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, after the death of the brother of the informant, these petitioners assaulted his dead body.
4. Learned counsel for the petitioners submits that these petitioners have been dragged in the present case merely because they happen to be family members
Patna High Court CR. MISC. No.53784 of 2023(2) dt.24-08-2023 2/2 of co-accused Chote Lal Yadav. It is alleged that after the death of the brother of the informant these petitioners assaulted him but in the post-mortem report doctor has found only one injury on the body of the deceased.

Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Nawada in connection with Rajauli P. S. Case No. 628 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
