2. The petitioner seeks regular bail in connection with Kudra P.S. Case No. 35 of 2025 dated 22.01.2025, registered for the offence(s) punishable under Section 137(2) and later on Sections 140(1), 103(1), 62(2), 238(a) and 3(5) of the B.N.S. were added.
3. As per the prosecution story, informant's nephew aged about two years went missing at around 9:00 A.M. on 22.10.2025 and later, the dead body of the minor child was found in a drain located on the western side of railway power grid near platform no.3 of Kudra railway station.
4. The main submissions advanced by petitioner's

No.51351 of 2025(3) dt.15-10-2025 2/3 counsel are that the petitioner has no criminal antecedent and has been languishing in jail since 06.02.2025, during the investigation, no witness claimed to have seen the petitioner's active participation in the commission of the alleged murder of the victim boy, as per the allegation, the petitioner simply took the victim to the house of other co-accused persons after giving him Kurkure (a snack) except this, no any other role has been alleged against this petitioner.

Learned counsel appearing for the State has opposed the bail prayer of the petitioner and submits that a two year old boy was brutally killed by the accused persons in which the petitioner was also involved and there are sufficient materials in the case diary to show the petitioner's involvement in the alleged crime.

Considering the seriousness of the occurrence which relates to the brutal murder of two year old boy though the same is alleged to have been committed in the name of witch craft practice but however, the occurrence is very serious as the victim was first taken to the house of other co-accused persons and thereafter, he was murdered and his dead body was recovered based on the disclosure of the accused persons and the petitioner was actively involved in taking the victim to the

No.51351 of 2025(3) dt.15-10-2025 3/3 house of the co-accused persons and with regard to the recovery of the incriminating materials, the petitioner's own statement is also relevant as detailed in the case diary, in my opinion, it is not a fit case for bail to the petitioner. Accordingly, his prayer for bail stands rejected.
7. However, considering the petitioner's custody period and his young age, the trial court is directed to expedite the petitioner's trial and conclude the same as early as possible. (Shailendra Singh, J) Rajiv/- U
