2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 489(B), 489(C), 34 of the Indian Penal Code.

3. It is a case of recovery of fake Indian currency notes of Rs. 40,000/- from possession of the co-accused Vishambhar Prasad Singh who disclosed that he had taken the currency from this petitioner and was bringing the same to Chhattisgarh.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the disclosure made by co-accused Vishambhar Prasad Singh, from which the alleged

Patna High Court CR. MISC. No.56087 of 2024(2) dt.02-08-2024 2/2 currency has been recovered. Nothing has been recovered from conscious possession of the petitioner. He has not concerned with the co-accused or with the recovery of fake currency. It is further submitted that the petitioner is languishing in judicial custody since 28.2.2024. similarly situated co-accused Vishambhar Prasad Singh has already been enlarged on bail by this Court vide order dated 9.1.2024 passed in Cr. Misc. NO. 51337 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kudhani P.S. Case No. 170 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Muzaffarpur.
