2. In the present case, the petitioner seeks bail in connection with Sherghati (Dobhi) P.S. Case No. 127 of 2023, registered for the alleged offence under Section 392 of the Indian Penal Code.

3. As per prosecution case, four persons on two motorcycles committed robbery in the CSP Centre of the informant and at gunpoint took away Rs.15,000-20,000/-. The name of the petitioner transpired during investigation for being involved in the said occurrence.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case on the basis of his confessional statement recorded under

Patna High Court CR. MISC. No.51467 of 2025(2) dt.12-08-2025 2/3 threat. The petitioner was arrested on 18.09.2024 in connection with Rampur P.S. Case No. 478/2024 and adopting unlawful means, the petitioner was made accused in this case on the basis of confession of his involvement in the present case. Nothing incriminating has been recovered from the person/possession of this petitioner. The learned counsel further submits that there is no material to connect the petitioner with the offence of robbery and except for the confessional statement, no other material has come up against the petitioner. The petitioner is in custody since 09.01.2025 and charge sheet has been submitted. The petitioner has been made accused in seven cases and in all cases, he has been made accused on suspicion and has been granted bail.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made hereinabove and considering the fact that no recovery has been shown from the petitioner and further considering the period of custody of the petitioner and submission of charge sheet, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Sherghati, Gaya/court

Patna High Court CR. MISC. No.51467 of 2025(2) dt.12-08-2025 3/3 concerned, in connection with Sherghati (Dobhi) P.S. Case No. 127 of 2023, subject to the conditions mentioned in Section 480

(3) of BNSS and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
