JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 The petitioner is apprehending her arrest in connection with Complaint Case No. 195C of 2015 for the offences instituted under Sections 323, 427, 504 and 379 of the IPC and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.

Heard learned counsel for the petitioner and learned counsel for the State.

It is alleged that the accused persons demanded Rs. 50,000/- from the informant and on non-fulfilment of same, the petitioner abused the informant by calling caste name. Accused Nilam Devi took out Rs. 1200/- from the informant. Accused Madhu Kumari, Munni Kumari, Arjun Thakur, Shanti Devi and other torn the clothes of the informant and again dragged and abused him and threw in a ditch and gave threatening of bad

Patna High Court Cr.Misc. No.29769 of 2015 (2) dt.28-07-2015 2/2 consequences in the event of lodging any case against them. Thereafter, the informant was taken to doctor and provided medical treatment.

It has been submitted on behalf of the petitioner that earlier to the alleged occurrence, the petitioner filed a case against the informant and others vide annexure-3 and the present case is out burst of the said case. It is further submitted that the provisions of SC/ST Act is not attracted as the occurrence is said to have taken place inside the house.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 195(C) of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. IInd Class, Munger, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
