JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 04-05-2016 The instant writ application has been filed by the petitioner for a direction to the respondents to lodge FIR against the accused persons in view of the direction made by the court in exercise of power conferred under Section 156(3) of the Code of Criminal Procedure in Complaint Case No. 1430(C) of 2015 and also for commanding the respondents to investigate the case properly and arrest the accused persons.

Learned counsel for the State has submitted that on the basis of complaint case bearing No. 1430(C) of 2015 filed by the petitioner before the jurisdictional Magistrate a case has already been registered bearing Ramkrishna Nagar P.S. Case No. 212 of 2015 on 03.09.2015 under Section 366, 366-A and 323 of the Indian Penal Code against the accused persons named in the complaint, namely, Bhushan Ravidas and Deepak Ravidas and others unknown and investigation of the case is being conducted in a fair and impartial manner.
