Petitioner seeks bail in Lalganj P.S. Case No.85 of 2017 instituted for the offence under Section(s) 323, 324, 354, 379, 364, 504, 506/34 Indian Penal Code.
In the written report, it is alleged that petitioner assaulted the informant while she was going to Hajipur with her son and forcibly got her seated in the vehicle along with her son after threatening to kill her son and subsequently threw her from the vehicle.
Counsel for the petitioner submits that as per First Information Report informant is Bhabhi of the petitioner. The son of informant has given statement under Section164 Cr.P.C., wherein, he has given totally different story from the allegation
Patna High Court Cr.Misc. No.67171 of 2018(2) dt.20-11-2018 2/2 made in the written report. It is further submitted that, now, good feeling has been restored between the parties and compromise petition has also been filed in the Court below, which is annexed as Annexure-2.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali, in connection with Lalganj P.S. Case No.85 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
