2. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 427, 506/34 of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against 4 named accused persons, including the present petitioner, in which the allegation is that the present petitioner attacked on the head of the informant by iron rod when he was on his way to home, due to which injury took place and the informant became unconscious.

4. Counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel submits that it is true that on the said date and place of occurrence only on a petty

Patna High Court CR. MISC. No.54638 of 2023(2) dt.23-08-2023 2/2 dispute scuffling took place between both the parties i.e. one party was doing patawan work and another party damaged the pipe of the former party, which resulted into a scuffling among them. He further submits that from the same date and place of occurrence two FIRs were lodged bearing Bhabua P.S. Case No.585 of 2023 and bearing Bhabua P.S. Case No.589 of 2023 from the informant's and petitioner's side respectively and injuries have taken place to both the sides. He further submits antecedent of the petitioner is clean and neither the petitioner's side nor informant's side are criminals.

5. Learned APP for the State opposes the prayer for bail.

6. In the present facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur in connection with Bhabua P.S. Case No.585 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J.) Ashishsingh/- U T
