1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273 of Indian Penal Code read with Sections 30(a), 32(i)(ii), 41(i) of Bihar Prohibition and Excise Act.
3. The learned counsel for the petitioner submits that petitioner has antecedent of two cases and allegation is of recovery of 5661 liters of liquor from a truck.
4. It is next submitted that petitioner was not arrested from the spot nor is the owner of the seized truck and came to be implicated at the instance of Chowkidar and thus was arrested and he is in custody since 18.06.2024.
5. The learned APP for the State opposes the regular
Patna High Court CR. MISC. No.57016 of 2024(2) dt.31-08-2024 2/2 bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. -1-cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Goraul (Kathara O.P.) P.S. Case No. 113 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
