Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-01-2020 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the persons arrested had disclosed the name of the petitioner, who was involved in unfair means in respect of examination conducted by the Bihar Staff Selection Committee. A report was called for from the court below. From perusal of the report, it appears that there is no chance of trial being concluded in near future.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.55077 of 2019(3) dt.17-01-2020 2/2 the petitioner is in custody since 13.04.2017 and has got no criminal antecedent. The petitioner has remained in custody for more than two and half years. There is no allegation of tampering of witnesses alleged against the petitioner. Other coaccused persons similarly situated have been granted bail vide Cr.Misc.No.72651 of 2018, 47740 of 2019, 30399 of 2019, 51573 of 2019, 70260 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance 1st, Patna in connection with Agamkuan P.S. case No.44 of 2017.
