The petitioners who bear clean antecedents have sought bail in anticipation of their arrest in connection with Gwalpara P. S. Case No. 14 of 2018 dated 08.02.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 594 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
The informant has alleged in the F.I.R. that many persons including the petitioners, variously armed with
Patna High Court Cr.Misc. No.66620 of 2018(2) dt.17-12-2018 2/3 weapons came to the place where he was sitting and assaulted him. Firing was also resorted to, which hit one of the villagers, namely, Md. Samad.
Learned counsel for the petitioners has submitted that nothing specific has been attributed to the petitioners. The informant is said to have received simple injuries and even the gun shot injury received by Md. Samad is simple in nature.
The petitioners do not have any criminal antecedents and the F.I.R. is completely silent about the cause of the occurrence.
Considering the aforesaid facts, petitioners, abovenamed, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Udakishunganj, district - Madhepura in connection with Gwalpara P. S. Case No. 14
