JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 323, 313 and 504 of the Indian Penal Code.
The basic accusation is of torture and getting the pregnancy terminated.
It is submitted by learned counsel for the petitioner that the petitioner filed Matrimonial Suit No. 182 of 2013 with a prayer for divorce whereas the complainant has filed a petition before the learned court below claiming maintenance, hence the petitioner is ready to make payment of maintenance amount but not ready to reconcile.

Patna High Court Cr.Misc. No.35023 of 2015 (2) dt.19-08-2015 2/2 that in spite of the fact that twice the pregnancy was forcibly terminated, the complainant is ready to reside with the petitioner. In the circumstance, let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with C.R. No. 338 of 2014 pending in the court of learned CJM, Madhubani. Accordingly, the application is disposed of.
