The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 8(C), 21(b) of N.D.P.S. Act.

It is a case of recovery of Smack. Seven sachet (puriya) of smack has been recovered from the conscious possession of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also

No.53767 of 2022(2) dt.16-01-2023 2/3 submitted that petitioner is languishing in judicial custody since 22.03.2022. it is also submitted that seven sachet (puriya) of smack has been recovered from the pocket of petitioner, when he was in unconscious position and the allegation levelled against the petitioner is totally false and petitioner has no concern with the alleged recovery of Smack. It is further submitted that similarly situated co-accused persons have been granted Bail vide order dated 17.11.2022 passed in Cr. Misc. No. 42710 of 2022, 43187 of 2022 and 55857 of 2022 by the co-ordinate Bench of this Court. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

Case No. 167 of 2022) on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IV/ concerned Court.
