The petitioner seeks bail in a case instituted for the offences under Sections 147, 341, 323, 324 and 307 of the Indian Penal Code.

Earlier this Court vide order dated 3.5.2016 passed in Cr. Misc. No. 18266 of 2016 rejected the prayer for bail of the petitioner.

Allegation has been made against the petitioner to have punctured the belly of Prem Nath Tiwary and this incident has taken place on the hit of moment. It was not a pre-planned incident.

Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.52730 of 2016 (2) dt.14-12-2016 case, let petitioner, Taraknath Tiwary, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Siwan in Pachrukhi (Sarai O.P.) P.S. Case No. 18 of 2015.
