1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504, 308 and 506/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is aged about 19 years. It is further submitted that the police, after threadbare investigation, came to a considered conclusion that petitioner is innocent and, thus, submitted final form bearing Final Form No. 135/23, dated 14.08.2023 but the learned Magistrate, based on the same investigation, differing with the police report took cognizance, thus, petitioner apprehends arrest. It is next submitted that when one investigating agency, after threadbare investigation, came to a considered conclusion that petitioner is
Patna High Court CR. MISC. No.56496 of 2024(2) dt.09-08-2024 2/2 innocent, whether it would be prudent for the Court to send the petitioner to jail as cognizance has been taken based on the same investigation which found the petitioner to be innocent.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Piri Bazar P.S. Case No. 101 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
