Petitioner seeks bail in a case registered under section 380 of the Indian Penal Code.
Petitioner is not named in the first information report nor any stolen article was recovered from his conscious possession but from perusal of the impugned order it would appear that in course of investigation, footage of CCTV was collected and it was noted that CCTV of ATM had caught the image of the petitioner and after that the petitioner was arrested and confessed before police that one Motilal Singh had given ATM card and pin number to him for withdrawal of amount from ATM.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedent, let the petitioner be
Patna High Court Cr.Misc. No.39073 of 2016 (2) dt.21-09-2016 released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Ara Town P.S. Case no. 331/2016.
