This application for regular bail arises out of Majhaulia P.S. Case No. 81 of 2021, disclosing offence punishable under Section 379 of the Indian Penal Code. The petitioner is in custody since 24.06.2021. The allegation relates to snatching of a motor bike which was subsequently recovered from the possession of a co-accused who is said to have disclosed the petitioner's name as one who had participated in the commission of offence. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has already remained in custody for more than nine months and the maximum
Patna High Court CR. MISC. No.62829 of 2021(2) dt.06-04-2022 2/2 punishment for the offence alleged is three years. Considering the aforesaid submission and the fact that the petitioner's name has surfaced on the basis of confessional statement of a co-accused, a case for grant of regular bail is made out. This application is accordingly allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in Majhaulia P.S.
