2. The petitioner seeks bail in connection with Manihari P.S. Case No. 147 of 2024 registered for the offence punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 30.010 litres of illicit liquor has been recovered from the motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case on the basis of suspicion. Nothing has been recovered from the physical or conscious possession of the petitioner. The petitioner is in jail since 27.06.2024.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.55568 of 2024(2) dt.14-08-2024 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-cum-Exclusive (Excise) Judge Court No. 2, Katihar/concerned Court in connection with Manihari P.S. Case No. 147 of 2024.

7. The petitioner will also mark attendance in Barari Police Station, Katihar on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
