Petitioner, who is in custody, seeks bail in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2018 registered for the offences punishable under Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act.
Informant who is a police officer has stated that on 16.09.2018 he got a secret information that petitioner along with other co-accused were unloading total 1215 liters of English liquor from a pick-up van thereafter when he raided at the said place along with other police personnel, petitioner and other coaccused fled away. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been
Patna High Court Cr.Misc. No.66682 of 2018(2) dt.22-11-2018 2/2 falsely implicated in this case due to ulterior motive. He was not arrested on spot. Nothing has been recovered from his possession. He is a poor labour. He has no criminal antecedent and he is in custody since 19.09.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special VIth -cum-Special Judge, Excise, Nalanda in connection with Giriyak P.S. Case No. 357 of 2018.
