JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code. It is alleged that petitioner no. 1 Md. Sami Hassan alias Minu, co accused Md. Chunnu and petitioner no. 2 Sohail Khan assaulted Md. Nazir causing head injury though other two accused persons also made assault.
It is submitted by the learned counsel for the petitioners that on conclusion of investigation, the petitioners were not sent up for trial but differing with the final form, cognizance has been taken and co accused Chunna alias Wasi Ahmad alias Chinu who
Patna High Court Cr.Misc. No.31741 of 2015 (2) dt.03-08-2015 2/2 was chargesheeted, has been granted anticipatory bail vide Cr. Misc. No.22201 of 2014 considering the fact that there is counter version of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Tarapur P.S. Case No.116 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
