Petitioners seek bail in connection with Complaint Case No. 177C of 2017 registered for the offences punishable under Sections 5, 7, 14 of Saw Mill Act and Section 29 and 32 of Wild Life Protection Act and Section 33, 41 and 42 of the Indian Forest Act.
Petitioners have earlier moved before this Court for grant of anticipatory bail which was allowed vide order dated 22.05.2018 passed in Cr. Misc. No. 24909 of 2018 and a period of four weeks was given to them for surrender before the lower court but due to chronic illness of petitioner no. 2, who is own
Patna High Court Cr.Misc. No.67321 of 2018(2) dt.28-11-2018 2/2 brother of petitioner no. 1, they could not surrender at prescribed time limit.
Learned counsel for the petitioners prays for extension of further four weeks.
Prayer is allowed.
Considering the ground of chronic illness of petitioner no. 2, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/product of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Munger, in Complaint Case No. 177C of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
