1. Heard learned counsel for the petitioners and the State.

2. The petitioners are aggrieved by the action of the respondent authorities in not regularizing them on Class-IV posts in Saharsa Collectorate despite their having worked on the aforesaid post on temporary basis for several years.

3. It has been submitted on behalf of the petitioners that they worked as daily-wage employees in

Patna High Court CWJC No.15751 of 2019 dt.13-08-2019 2/3 the Collectorate of Saharsa and the attached offices thereto. As a result of their having worked in the Collectorate, their names figured in the panel which was prepared in the year 1997. Later, their names found mention in other panels till about 2018.

The learned counsel for the petitioners has submitted that pursuant to Advertisement No. 03 of 2006, inviting application for being considered for empanelment for appointment on the Class-IV posts, the petitioners had applied and the petitioner no. 1 was placed at serial no. 226 whereas petitioner no. 2 at serial no. 249 in the panel prepared in the year 2014, which was finalized in the year 2017. However, despite the petitioners having all requisite qualifications and they belonging to reserved category, they were not appointed. The petitioners have also not been communicated any reason for their not being appointed even though their names fell in successive panels and ultimately in the panel which was prepared in the year 2018.

Under the aforesaid circumstances, this Court only directs the petitioners to make a representation before the District Magistrate, Saharsa (respondent No. 3) detailing their grievances, within a period of four weeks from today. On receipt of such representation, the District Magistrate, Saharsa (respondent No. 3), will pass a reasoned order within a period of four weeks thereafter.
