2 The petitioner apprehends arrest in Complaint Case No 1069 of 2018 registered for the offence punishable under Sections 323, 307, 504, 498A of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.
3 As per the prosecution case, the petitioner, who is husband of complainant, tortured and ousted the complainant from her matrimonial home.
4 Learned counsel for the petitioner submits that pursuant to the order passed by the Principal Judge, Family Court, Munger in Maintenance Case No 124 of 2018, the
Patna High Court CR. MISC. No.53438 of 2022(9) dt.17-08-2023 2/2 petitioner is paying Rs 3000/- per month as maintenance to Opposite Party No 2.
5 Learned APP has vehemently opposed the prayer for anticipatory bail.
6 Considering the rival submissions and in view of order passed in Maintenance Case No 124 of 2018 by the Principal Judge, Family Court, Munger, in the event of arrest/surrender within a period of six weeks from today, the petitioner above named be enlarged on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Munger in Complaint Case No 1069 of 2018 subject to the conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
