1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 21 of 2024 dated 11.01.2024 registered under Sections 414, 420, 467, 468 / 34 of the I.P.C.
3. The prosecution case in brief is that on 08.01.2024 the Police got the information that several stolen trucks were brought in a truck garage and were being sold after changing their registration no. Upon this information the Police raided the garage of one Shekhar Sharma wherein the work of changing the model of three stolen trucks was going on. The Police apprehended from that place two persons who disclosed their name as Ranjeet Kumar and Krishnanandan Kumar. The trucks were immediately identified by their owners and a few other

Upon inquiry, the apprehended accused persons disclosed that the said trucks were given by one Guddu Mistri i.e. the petitioner who runs a garage in the land of one Pintu Singh @ Chandraman Rai. It has further been alleged that the garage of the petitioner was raided by the Police and four trucks as identified by the vehicle owners and a few other trucks were recovered. The petitioner along with land owner succeeded in fleeing away.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of confessional statement of the co-accused whose garage was raided. The allegation against the petitioner is based on confessional statement and he is not concerned with the alleged occurrence. One of the co-accused / Chandrashekhar Sharma has been granted anticipatory bail by this Court in Cr. Misc. No. 34900 of 2024.

Learned counsel for the State opposes the prayer for bail and submits that on the basis of disclosure of name of the petitioner by the arrested co-accused the Police raided the garage of the petitioner also and recovered four stolen trucks identified by their respective owners along with other trucks.
6. Having regard to the submission made by the parties,
Patna High Court CR. MISC. No.57686 of 2024(3) dt.21-01-2025 3/3 taking into consideration the nature of allegation and the fact that stolen trucks were recovered from the garage of the petitioner from where petitioner succeeded in fleeing away, I am not inclined to grant anticipatory bail to the petitioner. The prayer for the same is rejected.
