JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 341, 323, 366A and 506/34 of the Indian Penal Code. Allegation against petitioners is that they assisted the main accused person in abducting daughter of informant for the purpose of marriage.

It has been submitted on behalf of petitioners that they are in custody since 4.9.2016. Chargesheet has been submitted against petitioners. Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. The victim has eloped with co-accused, namely, Awadhesh Baitha and they are residing in Mumbai. Petitioners have been made accused in the present case as they had also assisted the co-accused.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.51987 of 2016 (3) dt.21-12-2016 2/2 above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IV, Gopalganj, in connection with Vijaypur @ Bijaipur P.S. Case no. 78 of 2016.
