JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner and the State.
Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The prosecution case is that the complainant being
Patna High Court Cr.Misc. No.36580 of 2015 (2) dt.14-09-2015 field worker of the Fulkan India Company Limited, a nonbanking company collected Rs. 5,00,000/- from various investors and deposited in the company. Subsequently, the company found closed.
It is submitted by the learned counsel for the petitioner that petitioner was himself employee of the company and there is nothing on record to suggest that any money was given to petitioner. The money was admittedly collected by the informant himself and deposited in the alleged non-banking company In view of the above fact, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Desari P.S. Case No. 142 of 2014, pending in the court of learned Chief Judicial Magistrate, Hajipur.
With the above observation this application is disposed of.
