Mr.Mukesh Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-11-2021 Heard learned counsel for the petitioner and the State. Earlier prayer for bail of the petitioner was refused by this Court vide Annexure 1.

It is submitted on behalf of the petitioner that charge has already been framed and out of 6 witnesses, 4 of them have already been examined during trial and none of them have whispered name of the petitioner. It is further submitted that subsequently, co-accused Ranvijay Kumar @ Bhuletan Yadav has already been allowed bail by a co-ordinate bench of this Court vide Annexure 3 on whose confessional statement petitioner's name has figured during course of investigation. Petitioner is in custody since 2.7.2020.

Considering the period of incarceration of the petitioner and progress of the trial, prayer for bail of the

Patna High Court CR. MISC. No.62843 of 2021(2) dt.17-11-2021 2/2 petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in Sessions Trial No. 2295 of 2021.
