Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 380, 504 and 506/34 of the Indian Penal Code, registered in connection with Lakhisarai (Kabaiya) P.S.Case No. 551 of 2021.
As per allegation, when the informant Kanchan Devi went to her maike on the occasion of Raksha Bandhan, the accused persons took away her household articles such as almirah, dressing table, plung etc.
The learned counsel for the petitioners has submitted that petitioner no.1 is father-in-law and petitioner no.2 is Devar
Patna High Court CR. MISC. No.63180 of 2021(2) dt.19-07-2022 2/2 of the informant. She was making pressure upon her father-inlaw, petitioner no.1, for partition of the property and on denial, she has lodged this false case. The petitioners are persons of clean antecedents.
Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of CJM, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S.Case No. 551 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
