Petitioners apprehend arrest in a case registered for offence punishable under sections 302/34 of the Indian Penal Code.

Petitioners and other accused persons assaulted and strangulated Suraj Kumar to death.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case with ulterior motive though they were not even present on the place of occurrence and as a matter of fact victim died due to injuries sustained in accident. There is general and omnibus allegation of assault against all the accused persons and no specific overt

Patna High Court CR. MISC. No.63071 of 2021(3) dt.23-08-2022 2/2 act has been alleged against the petitioners. More so, occurrence took place on the spur of moment and it was not premeditated.

Learned counsel appearing for the State opposes the prayer for bail. He submits that the post mortem report reveals that the victim sustained injuries and died of cardiac arrest due to these injuries.

In view of the nature of allegation, prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
