This is a petition for grant of anticipatory bail for offence under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code.
For land dispute an occurrence of assault was allegedly committed by the named accused person, including the petitioner. The petitioner was carrying a lathi. Specific allegation is against co-accused, Toofani Bind, to have committed assault to Patru Bind with iron rod, as a result whereof Patru Bind died.
Considering the nature of allegation, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Piprasi P.S. Case No. 34 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, II, Bagaha, West Champaran, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
