Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Shastri Nagar P.S. Case No. 94 of 2022 registered for offence punishable under sections 341, 342, 323, 364, 504 and 506/34 of the Indian Penal Code, 1860.
As per allegation, co-accused Ashutosh Kumar Singh came to the shop of the informant and asked him to go to the disputed land apprising him that he has taken agreement of that land from one Amitabh Chandra Mukum. The accused persons
Patna High Court CR. MISC. No.53081 of 2022(2) dt.30-01-2023 2/3 assaulted him and they made a pressure to sign on stamp paper. On protest, they demanded Rs.50 lacs as ransom. By drawing my attention towards Annexure-2, the learned counsel for the petitioner has submitted that there was already an agreement to sale between one Sri Manoj Kumar and the present petitioner and in that agreement to sale, it has been mentioned that the said land was obtained by the vendor Manoj Kumar from the informant through sale deed for consideration money of Rs. 36 lacs. He has submitted further that as a matter of fact when the petitioner asked the members of the prosecution side to execute the sale deed, it was the reason that he has falsely been implicated in this case.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Patna in connection with Shastri Nagar P.S. Case No. 94 of 2022, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove,
