Petitioner is the tempo driver, which was used during course of intercepting a truck, which was taken away by the miscreants after ousting the driver on whose statement, instant case has been registered. Fortunately, the truck was seized along with the miscreants and during course thereof, the name of petitioner transpired on account of inculpatory extra-judicial confessional statement. Though, petitioner has got criminal antecedent, but is under custody since 21.04.2016. That being so, petitioner, Sujay Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.43102 of 2016 (03) dt.13-12-2016 satisfaction of Mr. Sunil Kumar Tripathi, Judicial Magistrate, 1st Class, Muzaffarpur in connection with Aurai P. S. Case no.27 of 2016, but considering the criminal antecedent of the petitioner and further, to prevent from having his indulgence in future, one of the bailors should be a government servant and the learned lower Court before acceptance of the bail bond will ascertain the identity of the bailor, who will also give an undertaking that henceforth petitioner will not indulge himself in such type of activities like robbery, dacoity etc.
