JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 The petitioner seeks regular bail in connection with Hisua P.S. Case No. 261 of 2018, registered for offences punishable under Sections 366(A) of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.

It has been submitted on behalf of the petitioner that the girl in her statement under Section 164 Cr.P.C. has stated that she has love affair with the petitioner and medical report of the girl shows that she is major. Further petitioner has no criminal antecedent and has been in judicial custody since 13.09.2018.

learned counsel for the State opposed the prayer for bail and submitted that the girl is minor.

No.67632 of 2018(2) dt.28-11-2018 2/2 Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the concerned court below to verify the age of the victim girl from the medical report and if it is found that the girl is major, the court below shall release the petitioner on bail to his own satisfaction with condition that he will cooperate in disposal of trial.
