The petitioner is apprehending his arrest in connection with Kotwali P.S. Case No. 356 of 2018 for the offence under Sections 376 of the Indian Penal Code and Section 8 of POCSO Act, 2012.
Learned counsel appearing on behalf of the petitioners submits that the victim in her statement recorded under section 164 Cr.P.C. admits that she is major and at her own volition she has joined sexual relationship with the petitioner and she is ready to stay with the petitioner.
Considering the aforesaid the Court is inclined to grant privilege of anticipatory bail, subject to the conditions that
Patna High Court Cr.Misc. No.71251 of 2018(2) dt.17-12-2018 2/2 Court below at the time of release of the petitioner once again record the statement of victim and after ascertaining the age of the victim and on satisfaction as to majority of the victim and on recording her statement that she voluntarily joined wedlock with the petitioner, the Court below shall released the petitioner on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Court of learned A.D.J., 1st, Gaya, in connection with Kotwali P.S. Case No. 356 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
