The petitioners seek bail in Khaira P.S. Case No. 372/2018, instituted for offences under Sections 272, 273 and 120B/34 of the Indian Penal Code read with Sections 30(a) and 38(1) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that during vehicle checking, 150 litres of country made liquor along with 8 pieces of Blenders Pride each containing 375 ml, 4 pieces of GODFATHER Strong Beer each containing 500ml were recovered from a tempo.
Learned counsel for the petitioners has submitted that these petitioners were found sitting in the aforesaid tempo as
Patna High Court Cr.Misc. No.69019 of 2018(2) dt.30-11-2018 2/2 passengers. They were arrested by the police whereas other persons managed to run away.
Petitioners are in custody since 23.09.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. District & Sessions Judge, Jamui in connection with Khaira P.S. Case No. 372/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
