2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 363/366A of the Indian Penal Code.

3. As per the prosecution case, petitioner kidnapped minor daughter of the informant for the purpose of marriage.

4. Learned counsel appearing for the petitioner submits that during investigation the victim in her section 161 Cr.P.C. statement has stated that out of her sweet will, she left the house and married this petitioner. Petitioner claims clean antecedent.

5. Considering the aforesaid statement of the victim, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner,

No.53981 of 2023(3) dt.04-09-2023 2/2 mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in Banka Police Station Case No. 264 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
