Mr. Kalyan Shankar , APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-08-2025 After some arguments, learned counsel for the petitioners seek permission to withdraw the pre-arrest bail petition of petitioner No. 1 .
2. Permission is accorded.
3 . This bail petition of petitioner No. 1 is dismissed as withdrawn .
4. Heard learned counsel for the petitioner No. 2 and the State .
5 . Petitioner apprehends arrest in a case registered for the offence punishable under sections 126 ( 2 ), 118 (1) , 118 ( 2 ), 109, 303 ( 2 ) and 3(5) of BNS.
6. As per the prosecution case , informant namely
Patna High Court CR. MISC. No.52821 of 2025(2) dt.20-08-2025 2/3 Ankit Kumar alleged that on 12.05.2025 in the night one Abhishek Kumar informed to informant that all the F.I.R. named accused persons including his petitioner snatched mobile and cash from brother of informant and on protest, all the accused persons assaulted him with knife on his neck due to which brother of informant sustained injury .
7. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. Specific accusation of assault is against other co-accused persons and so far as this petitioner is concerned, he is only alleged to have caught hold of the injured and there is absolutely no allegation of assault is against this petitioner. Petitioner claims clean antecedent.
8 . Learned counsel for the State opposes the bail petition of the petitioner.
9. Considering the aforesaid facts, clean antecedent of petitioner No. 2 and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner No. 2, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - I Danapur District- Patna
Patna High Court CR. MISC. No.52821 of 2025(2) dt.20-08-2025 3/3 in connection with dANAPUR P.S. case No. 483 of 2025 subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
